Costs information for estate administration

Costs information for the collection and distribution of money, property and other assets belonging to a person following their death, where all assets are in the jurisdiction of England and Wales and matters are not contested.

There is no such thing as a typical estate and we will always give you a costs estimate tailored to your particular circumstances if you instruct us.

In a sample of 39 estates finalised during 2018 our charges have averaged at £2,874 plus VAT and the expenses outlined below. Nine of these cost under £1,000 plus VAT and only nine cost over £3,500 plus VAT. In a third of them, the information-gathering was done by the family.

Costs are based on an average hourly rate of £194 plus VAT.

The costs indicated exclude VAT, which will be charged in addition at the prevailing rate.

The following factors are likely to put your estate above this average:

  • Large number of different asset holders
  • Large number of shareholdings
  • Large number of beneficiaries
  • Inheritance Tax payable
  • Property taking a long time to sell, causing issues with insurance and ongoing utility bills
  • The deceased did not make a Will and family tree research is required
  • Frequent queries from beneficiaries

The following factors are likely to put your estate costs below this average:

  • Few assets
  • No tax payable
  • You register the death and provide the date of death asset values yourself
  • Only one beneficiary
  • No shares
  • Grant not required

Particularly complex estates have not been included in the sample as these give values which are not indicative of the most common types of estates.

There will be other expenses in addition to the above charges. These are items which we will have to pay for on your behalf as part of the process. These include -

  • the £155 fee (no VAT) payable to the Probate Registry, plus
  • 50p (no VAT) for each official copy of the Grant of Probate required
  • approximately £146 (plus VAT) for statutory newspaper advertisements for creditors (optional)

These are likely to total approximately £302 plus VAT where relevant.

You are likely to be charged indemnity fees by Registrars if share certificates are missing. These charges vary depending on the value of the shares.

This information is designed to enable you to calculate an estimated cost of the estate administration, with the actual cost depending upon a number of factors which we can discuss with you further if you would like to contact us to arrange a specific quotation.

Regardless of who works on your matter, they will be supervised by either Tim Selley or Mark Turner.

The work we carry out may include the following :

  • Information gathering (two to four weeks on average)
  • Preparation of HMRC and Probate Registry statutory paperwork to pay Inheritance Tax (if applicable) and obtain the Grant (four to eight weeks)
  • Using the Grant to gather in the estate assets and pay the estate expenses (two to four weeks)
  • Accounting for income tax and capital gains tax during the administration period (dependent on HMRC reply time)
  • Preparation of estate accounts for the beneficiaries
  • Distributing the assets in accordance with the terms of the will. It may be appropriate to wait until 10 months after probate has been granted before distributing in case there are any challenges to the Will.

These costs do not include any conveyancing costs. Where estates include properties which are sold, conveyancing is quoted and dealt with separately by the firm’s Property Department. Similarly, first registrations of unregistered properties and lease extensions are quoted and dealt with separately.

Our costs do not include the external costs and charges which may be incurred as part of the estate administration and which will be borne by the estate, such as tax, repayment of overpaid pensions and benefits, valuation fees, utility bills and other charges.
