How will the house and other financial assets be shared on divorce or separation?

There is no set formula for sharing the house, savings, income or other assets between you and your partner.  The outcome for you depends on a range of factors and, on the particular circumstances of your situation.  For example: the length of a marriage, the contributions that you have each made to the assets, the needs of you and your children, can all be relevant.  This can be a complex area so expert advice is vital to help you obtain a fair outcome that meets the needs of you and your family.

Will I have to go to Court?

You may be worried about the financial cost and emotional strain of going to court.  In most cases we are able to help our clients reach a suitable settlement without using the court.  There is a range of ways to do this: by negotiation through solicitors, collaborative law, or mediation.  We will take time to help you find the option for you.

In some cases we may advise you to make an application to court, for example where agreement cannot be reached, or where urgent issues arise.  The court will issue a formal timetable so that the process will not stall.  Negotiations outside of court can continue alongside the court process.

What about our children?

If you have children, you may be concerned about how the divorce or separation will affect them.  Issues over where the children will live, how much time they spend with each of you and other parenting matters can often arise.  With the right advice and a common sense approach, we can help you resolve these issues effectively and help you to ensure that the emotional impact on the children is kept to a minimum.
