General Debt Recovery

We at Crosse + Crosse Solicitors are happy to deal with debt recovery cases.

Frequently Asked Questions

How much will it cost?

The cost will depend on the size and type of the debt. For bulk referrals we are able to offer competitive fee structures to suit the needs of the client. If Court proceedings are needed then there are fees payable in addition.

How long will it take?

It is difficult to advise on how long your claim may take as this will vary depending on the type of case. Relatively simple cases that are not defended may settle very quickly.  Other matters may take several months, particularly if the claim is defended.

Can I claim interest?

You can claim interest on most claims but this depends also on some of the factual circumstances of each individual case and Court Rules.  We will advise you on each individual matter accordingly.

Can I recover my costs?

Generally, in Small Claims matters (less then £5,000) you are not entitled to recover anything other than fixed Solicitors costs (between £50 - £100) and your Court fee and only if you are successful.

What if I lose?

If you lose your case you will be required to pay our costs and in some circumstances (with Small Claims, if the Court finds that you have acted unreasonably), you may also be ordered to pay your opponent's costs.

What happens if the debt is challenged?

We can advise you so that you can decide whether or not to pursue your claim.

What happens with getting any judgment paid?

We can assist with the options available to seek to enforce payment of judgments.

How can I obtain further information on your services and likely costs?

Please contact one of our team members who will be happy to provide such further information.
