Park Homes - Quiet Enjoyment

Tim Selley’s client Jack Parr became frustrated over his rights to “quiet enjoyment” of his plot being ignored by his site owner and in the end and with Tim’s help made a claim to the Tribunal.

The “mobile homes implied terms” set out the “rules” a site owner has to follow.  The site owner Steve Bishop would just ignore them.

In the case the Tribunal restated the fact that Jack was entitled to quiet enjoyment and ordered Mr Bishop to pay him £500 compensation and also to refund his Tribunal application fee.

Tim says “the case is a reminder to site owners they should respect the rights of home owners to their privacy as to their home and plot”.
