Success on Power of Attorney Claims

Often the making of a "Lasting Power of Attorney" is a sensible step to take.

However sometimes there are occasions where the person holding the power (“the donee”) abuses that position. Partner Tim Selley has just settled two such claims for sums totalling over £240,000. In both cases he acted for family members who found out the donee had themselves been “given” this money by the person who gave the power. In both cases he succeeded in recovering money for his clients, who had lost out financially as a result. Tim says “With these cases the law often means that the donee should not themselves benefit from the assets of the person whose money affairs they are handling”.
